Applies to: joshuaoparachukwu.com and all consultations, discovery calls, workshops, and advisory engagements booked through it.

1. Who We Are

These Terms of Use ("Terms") govern your access to and use of joshuaoparachukwu.com (the "Site") and any consultation, discovery call, workshop, or advisory engagement booked through it (together, the "Services"), provided by Oparachukwu Joshua Ayodeji, a performance psychologist practicing under the name Dr. Joshua A. Oparachukwu, and operating under MindGame Africa and SportLead Africa ("the Consultant," "we," "us").

By using the Site, submitting a booking form, or paying for a discovery consultation, you ("you," "the Client") agree to these Terms. If you are booking on behalf of a club, team, academy, federation, or organization, you confirm you are authorized to bind that organization, and "you" includes that organization where the context requires.

2. Services We Offer

Each of these, as described on the Site, is a paid discovery consultation: a scoping conversation to understand your situation and determine an appropriate direction. The fee for a discovery consultation covers the time of that conversation only. It is not payment for an intervention, therapy, ongoing coaching, or a guaranteed program of work. Where ongoing support is appropriate, it is proposed separately, in a written proposal, with its own scope, duration, and price, which you are free to accept or decline.

Nothing on the Site or in a discovery consultation obliges you to purchase further services, and nothing obliges the Consultant to offer further services following a discovery consultation.

3. Nature of the Services — What This Is Not

The Services are performance psychology consulting, coaching, and advisory work. They are not, and must not be represented or relied upon as:

  • Clinical mental health treatment, psychiatric care, diagnosis, or therapy for a mental health condition;
  • A crisis, emergency, or twenty-four-hour service;
  • An assessment, scouting, selection, or recruitment service for players, coaches, or staff;
  • A guarantee of any particular outcome. NO PROMISE is made that any individual, team, or organization will improve in performance, results, confidence, culture, governance, or standing.

If a matter raised in a consultation falls outside the scope of performance psychology or performance advisory work, including any indication of a mental health condition requiring clinical care, the Consultant will say so and, where appropriate, suggest you seek an appropriately licensed practitioner. The Consultant is not a substitute for medical, psychiatric, or legal advice.

If you are in crisis or at risk of harm to yourself or others, this Site and these Services are not the appropriate resource. Please contact a licensed emergency or crisis service in your location.

4. Eligibility and Minors

The Services on this Site are intended for adults (18 and over) and for organizations acting through an authorized adult representative. Where the Consultant works with individuals under 18, for example, through a club or academy partnership, that work is governed by a separate written parental/guardian consent and safeguarding process, not by a booking made through this Site. If you are under 18, do not book a consultation through this Site; ask a parent, guardian, or your club to contact the Consultant directly.

5. Bookings, Fees, and Payment

Fees for discovery consultations are stated on the Site at the time of booking and are payable in advance to confirm your slot. Prices are shown in United States dollars, unless otherwise stated; where you are billed in a different currency through a payment processor, minor variations due to exchange rates or processor fees are outside the Consultant's control.

Payment is processed by a third-party payment provider. The Consultant does not directly store your full payment card details. See the Privacy Policy for more on this.

Discovery consultation fees are non-refundable once the session has taken place, except where the Consultant is unable to attend at the scheduled time, in which case you will be offered a reschedule or a full refund at your choice. Where a proposal for ongoing engagement is accepted following a discovery consultation, the payment terms for that engagement will be set out separately in writing and are not governed by this Section.

6. Cancellation and Rescheduling

You may reschedule a booked discovery consultation by giving at least twenty-four (24) hours' notice through the booking channel, at no additional charge. Cancellations or reschedule requests made with less notice than this may forfeit the fee paid, save where exceptional circumstances apply and at the Consultant's discretion.

7. Confidentiality

What you disclose in a consultation is treated as confidential and is not shared with your employer, club, teammates, family, or any third party, except in the limited circumstances below. Where you are booking on behalf of, or in connection with, a team or organization, information about a named individual's participation or the content of an individual consultation is not shared with the organization without that individual's consent.

Limits of confidentiality:

The Consultant may disclose the minimum information necessary, to the minimum necessary recipient, only where, in reasonable professional judgment:

Where safe to do so, the Consultant will tell you before making any disclosure.

8. Session Recording

All consultations are conducted online, and they are recorded, including through an AI meeting assistant that transcribes and summarizes the session, for the Consultant's professional practice: accuracy of notes, de-identified professional supervision, and skill development. Recordings and notes are not shared with any third party without your consent, save under the limits of confidentiality in Section 7.

9. Intellectual Property

All frameworks, models, worksheets, slides, tools, reports, and other materials created or used by the Consultant in connection with the Services ("Consultant Materials") remain the property of the Consultant. Where Consultant Materials are provided to you as part of an engagement, you receive a personal, non-exclusive, non-transferable license to use them for your own internal purposes. You may not reproduce, resell, sub-license, or publicly redistribute Consultant Materials without written permission.

10. Testimonials, Case Studies, and Media

The Consultant may publish anonymized, de-identified case studies drawn from recurring themes in the work, in a form from which no individual or organization can reasonably be identified. Named testimonials, photographs, or video are only used with the specific, separate consent of the individual or organization concerned, obtained at the time. Providing a testimonial or being featured in media is always voluntary and is never a condition of receiving the Services.

11. International Clients

The Consultant works with clients based outside Nigeria, including in Europe, India, and the Middle East. Services are typically delivered remotely/online. Nothing in these Terms is intended to displace mandatory consumer protection or data protection rights you may have under the law of your own country; where such mandatory rights apply and conflict with a term here, the mandatory right prevails to that extent.

12. Limitation of Liability

To the maximum extent permitted by law, the Consultant's total liability arising out of or in connection with the Services, however arising, is limited to the amount you paid for the specific consultation or engagement giving rise to the claim. The Consultant is not liable for indirect, consequential, or reputational loss, or for any decision made by you or your organization based on advice given, including selection, personnel, or governance decisions. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded.

13. Complaints

If you have a concern about the Services, contact the Consultant directly at mailjoshuaoparachukwu@gmail.com. Complaints are acknowledged within seven (7) days and responded to in writing within twenty-one (21) days. A complaint alleging a breach of confidentiality is treated as the most serious category and is acknowledged within twenty-four (24) hours.

14. Changes to These Terms

These Terms may be updated from time to time. The version in force is the one published on the Site at the time you book a consultation. Material changes will be reflected by an updated "Effective date" at the top of this page.

15. Termination

The Consultant may decline to provide, or may discontinue, Services to any individual or organization at its discretion, including where continuing would compromise confidentiality, professional ethics, or safety. Fees already paid for consultations not yet delivered will be refunded in that case.

16. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute not resolved by good-faith discussion will be submitted to mediation before a single agreed mediator, and failing that, to the exclusive jurisdiction of the courts of Oyo State, Nigeria.
