EU/UK Visitors: General Data Protection Regulation (GDPR) / UK GDPR applied on a best-efforts basis.
1. Introduction
This Privacy Policy explains what personal data Dr. Joshua A. Oparachukwu ("we," "us," "the Consultant") collects through joshuaoparachukwu.com ("the Site") and through the consultations, discovery calls, workshops, and advisory engagements booked via it, how it is used, and the rights you have over it.
2. What Personal Data We Collect
Data you give us directly:
- Booking form data: name, email, phone/WhatsApp number, country, time zone, organization name, role, and the description of the challenge you're facing, submitted through the Site's consultation booking forms.
- Newsletter data: your email address, if you subscribe.
- Consultation content: what you say during a paid discovery consultation or any subsequent engagement, including any notes or recordings taken (see Section 5).
- Payment information: processed by our third-party payment provider; we do not directly store your full card details.
- Testimonials and media: name, photo, video, or written testimonial, but only where you have separately and specifically consented to this.
Data collected automatically:
- Standard website usage data (pages visited, browser type, approximate location from IP address) via the Site's hosting and analytics tools.
- Cookies; see Section 9.
3. How We Use Your Data
- To respond to your booking request and deliver the discovery consultation or engagement you've requested;
- To prepare a proposal for further work, where relevant;
- To send you the newsletter, if you've subscribed (you can unsubscribe at any time);
- To maintain professional records of consultations, for continuity of care and, in de-identified form, for supervision and professional development;
- To publish testimonials or media, only where you've specifically consented;
- To meet legal, safeguarding, or professional obligations.
4. Legal Basis for Processing
We process your data on the basis of: your consent (for the newsletter, testimonials, and consultation content); the steps necessary to provide a service you've requested (booking and delivering a consultation); and, in narrow circumstances, a legal obligation (for example, a safeguarding or legal disclosure requirement described in Section 6). Where you are in the European Union or United Kingdom, these bases are intended to align with Articles 6(1)(a), (b), and (c) of the GDPR.
5. Confidentiality of Consultation Content
What you disclose during a paid consultation is treated as confidential professional information, not merely as routine business data. It is not shared with your employer, club, family, or any third party, except in the following limited circumstances, and then only the minimum necessary information to the minimum necessary recipient:
- A serious and identifiable risk to your life or safety, or to someone else's;
- A concern regarding the welfare of a child or vulnerable adult; or
- A legal or court requirement to disclose.
Where safe to do so, we will tell you before making any such disclosure.
6. Session Recording
All consultations are online and all online consultations are recorded, including via an AI meeting assistant that transcribes and summarizes the session. Recordings are used only for the Consultant's own professional practice, accuracy of notes, de-identified supervision, and skill development; and are not shared with any club, employer, or third party without your consent, subject to Section 5. Recordings are stored securely and are not publicly accessible.
7. Who We Share Data With
We share limited data with the following categories of third-party processor, solely to operate the Site and deliver the Services:
- Payment processor: to process discovery consultation fees;
- Booking/scheduling platform: to manage appointment slots;
- Email/newsletter provider: to send newsletter content to subscribers;
- AI meeting/transcription tool: where a session is recorded, as described in Section 6;
- Website hosting provider: to host and serve the Site.
We do not sell your personal data to any third party, and we do not share consultation content with any club, employer, family member, or organization without your consent, except as set out in Section 5.
8. International Data Transfers
Because we work with clients across Nigeria, Europe, India, and the Middle East, your data may be processed or stored on servers located outside your home country, including in Nigeria or wherever our third-party processors host their infrastructure. Where you are in the EU/UK, we take reasonable steps to ensure any such transfer has appropriate safeguards in place, such as standard contractual clauses used by our processors.
9. Cookies
The Site may use essential cookies necessary for it to function, and analytics cookies to understand how visitors use the Site. Where required by your location, you will be asked to consent to non-essential cookies on your first visit. You can control cookies through your browser settings at any time.
10. Data Retention
Booking form and consultation data is retained for as long as professionally and legally necessary, indicatively SEVEN (7) years from your last contact with us, after which it is securely destroyed. Newsletter data is retained until you unsubscribe. Testimonial/media data is retained until you withdraw consent, after which we stop new use but are not required to recall material already published.
11. Your Rights
Subject to applicable law, you have the right to: access the personal data we hold about you; request correction of inaccurate data; request erasure of your data; withdraw consent at any time (this does not affect processing already carried out); and object to certain processing. To exercise any of these rights, contact mailjoshuaoparachukwu@gmail.com. If you are unsatisfied with our response, you may complain to the Nigeria Data Protection Commission or, where applicable, your local data protection authority.
12. Children's Privacy
This Site's booking forms are intended for adults (18+) and organizations acting through an authorized adult. We do not knowingly collect personal data from children under 18 through the Site. Where the Consultant works with individuals under 18 through a club, academy, or league partnership, that data is collected under a separate written parental/guardian consent process, not through this Site. See the relevant partnership agreement for those terms.
13. Security
We take reasonable technical and organizational measures to protect your data, including restricting access to consultation records to the Consultant alone (save for de-identified supervision), and using reputable third-party processors for payment and hosting. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
14. Changes to This Policy
We may update this Privacy Policy from time to time. The version in force is the one published on the Site, with the "Effective date" updated accordingly. Material changes affecting how we use your data may be highlighted.
